Unjustified Court Verdict At Lusaka High Court, Dr. Mahtani Appeals To Higher Court

Dr. Rajan Mahtani is a noted businessman, philanthropist and industrialist with more than 30 years of business experience in Zambia. He is also among those few businessmen in Zambia who have been following the path of honesty and transparency even when facing several conspirators on a regular basis.

Portland Cement Zambia is a noted cement-manufacturing factory in Zambia. For the past ten years, Dr. Rajan Mahtani has been fighting a case for the legal takeover of the factory. However, he has not been given justice despite several strong attempts to prove his legal ownership over the factory with numerous evidence, documents and testimonials. Some of the strongest and powerful evidence were submitted by Dr. Mahtani’s lawyers over the years, including a signed shareholder’s agreement, financial exhibits and documents which clearly indicate his financial investments of more than USD 12 million in the factory as well as numerous other testimonials from important members associated with the factory. Another strong evidence was the independent audit report conducted by an independent auditor on the factory. According to this audit report, the Portland Cement Zambia was established as a joint venture and Dr. Mahtani is the sole joint venture partner of the factory which majority shareholding. This clearly makes him the legal owner of the factory.

The final judgment came a few weeks back and it shocked everyone. Somehow, the judge was able to ignore almost all of the evidence and documents shared in defense of Dr. Mahtani and gave the final judgment against him. It was clear that the judgment was misdirected and the judge clearly did not consider any of the evidence shared in favor of Dr. Mahtani during the trials. Notwithstanding this skewed judgment, Dr. Mahtani and his lawyers have now appealed to the higher court of Zambia against the decision given at the high court. All hope is not lost and Dr. Mahtani is expecting honest and transparent judgment and the decision from the higher court of appeal. Dr. Rajan Mahtani
