Former Chairman Finance Bank, Zambia was arrested on acceptable ground

Mwiinde Siavwapa, the Lusaka High Court Judge, certainly feels that the arrest of the former Finance Bank Chairman in June 2015, was based on misuse of power. It was ‘unfortunate’ that people like acting DPP and Attorney General have reopened a case which was already closed by a respected judge in 2012. The actions have not only mocked the Zambian law, but has also exposed the amount of corruption which Zambia is facing at the moment.

The judgement which was passed in 2012 in respect of Dr. Mahtani had clearly mentioned that all charges which were put on the former Chairman Finance Bank, Zambia was fake and hence, he was released from them with dignity. However, with time the same charges were mysteriously brought to the notice of the acting DPP and Attorney General, who without considering the situation quickly jumped into reopening the case.

It should be known to all that it is not the person who matters during passing a judgement, but the seat which he is occupying. A judge’s seat represents honor, uniformity and unbiasness. The decision which has been passed by him cannot be challenged in the same court or be reopened after a few years. Nevertheless, the conspirators ignored all the consequences and kept offering bundles of notes for getting their work done.

Sources reveal that the incident came to light only after the minority shareholders of the Zambezi Portland Cement Factory decided to dig up the matter once again with their imaginative claims and fake stories. Just after the case was closed, once again, by Hon’ble Judge Mwiinde Siavwapa, the conspirators have come out with another claim that the former Chairman Finance Bank, Zambia had bribed the judge to offer a decision in his favour. Zambia Reports, as usual, has allowed the conspirators to ventilate their feelings.
