A case was registered at the Lusaka High Court by Dr. Rajan Mahtani claiming this illegal takeover. The Ventriglias, on the other hand, defended themselves by saying that the shares owned by Dr. Rajan Mahtani are not paid for. While it has been more than 10 years, the court has not been able to provide any sound judgment. This is despite the fact that Dr. Mahtani’s lawyers have submitted almost all documents and evidences that capture the real facts and legal bindings related to the factory. One of them is an independent report from an auditor who conducted as independent audit on the factory. As per the report, the Portland Cement Zambia factory was established as a joint venture with Dr. Rajan Mahtani as the sole joint venture partner. Rest all were just minor shareholders. This report along with other evidences such as financial exhibits and signed shareholder’s agreement completely provide the actual view of the Portland Cement Zambia’s legal leadership.

The judge currently handling the case announced that the case hearing has been closed and both sides are required to share their evidences in written and oral format, post evaluation of which, final judgment will be announced. Experts have suggested sweeping win for Dr. Rajan Mahtani.
